At Nykam Solutions LLC, consulting engagements are customized professional services that may involve business analysis, strategic planning, proprietary frameworks, process evaluation, project management, technology assessment, automation, and implementation. Because meaningful consulting work begins before a final deliverable is produced, refunds and cancellations are based on the stage of the engagement and the services already provided. This policy should be read together with our Terms of Use, Confidentiality Policy, and any applicable proposal or engagement agreement.
Nykam Solutions LLC offers a complimentary 20-minute Discovery Call for prospective clients, to determine whether your needs align with our services and whether the engagement is a mutual fit. This call is not a consulting engagement. No payment is required, and no refund applies.
A paid engagement begins when a client selects a service or package and submits payment. The applicable proposal, service description, or engagement agreement establishes the specific services included, payment schedule, and any engagement-specific terms. By booking a paid service, you acknowledge that substantive consulting services begin with the Diagnostic and Onboarding Session.
Unless different terms are stated in the applicable engagement agreement, cancellation requests received within 48 hours of purchase, and before the Diagnostic and Onboarding Session has occurred, may be eligible for a refund of amounts paid, less any non-refundable payment processing fees. After that period, Nykam Solutions LLC may have already reserved professional time, prepared for the engagement, or begun engagement-specific work, and any refund at this stage will be determined according to the applicable service agreement and the work already performed.
The Diagnostic and Onboarding Session is a paid consulting service, not a complimentary call. It establishes the foundation of the engagement and may include understanding how your business operates, reviewing objectives and priorities, applying elements of our proprietary frameworks, identifying systems and processes requiring analysis, and establishing the scope and direction of the work.
Once the Diagnostic and Onboarding Session has begun, payments made for the engagement are non-refundable. This applies regardless of whether the engagement's final deliverables, implementation work, or automation have been completed. The absence of a completed final deliverable does not mean that consulting services have not been provided.
Consulting value is not limited to a finished document, system, or implementation. During the Diagnostic and Onboarding Session, we begin applying professional analysis, experience, proprietary frameworks, and business-specific recommendations to your circumstances. You may leave the session with greater clarity regarding what is happening within your business, where problems or risks may exist, what should be prioritized, and how the engagement should proceed. This value cannot be returned in the same way a physical product can be returned. Accordingly, once the Diagnostic and Onboarding Session begins, the engagement enters the substantive service phase and payments are non-refundable, subject to any rights that cannot legally be waived under applicable law.
You may discontinue an engagement after the Diagnostic and Onboarding Session by providing written notice. Cancellation does not create a right to a refund for services already performed, completed milestones, time reserved and committed, or work already initiated. For engagements using milestone billing, future milestones that have not yet begun may be cancelled in accordance with the applicable engagement agreement. Any unpaid amount associated with work already completed or substantially performed remains due.
Larger or multi-stage engagements may be divided into milestones, such as Diagnostic and Analysis, Strategy, Design, Implementation, Automation, and Completion. The specific milestones and payment schedule are identified in the applicable proposal or engagement agreement. Once work on a milestone begins, payment for that milestone is considered committed and is non-refundable. Where appropriate, we may allow a client to discontinue future milestones that have not yet begun, without affecting payment obligations for work already completed.
Please provide at least 24 hours' notice when requesting to reschedule a scheduled session. We will make reasonable efforts to accommodate rescheduling requests based on availability. Repeated rescheduling, late cancellations, or failure to attend scheduled sessions may affect the engagement timeline and may result in the session being considered delivered.
A scheduled paid consulting session that is missed without appropriate notice may be considered used. We may, at our discretion, offer one opportunity to reschedule based on availability. A missed session does not automatically extend project deadlines, milestone dates, or payment obligations.
Clients are responsible for providing information, documentation, access, approvals, and other materials reasonably necessary to perform the engagement. Delays caused by the client do not automatically create a right to a refund or cancellation of payment obligations. If a client-caused delay materially affects the engagement, we may revise the project schedule, adjust milestone dates, or require additional fees where the delay results in work outside the original scope.
A decision to change the objectives, scope, direction, or desired outcome of an engagement does not create a right to a refund for services already performed. Material changes may require a revised proposal, additional fees, or a separate engagement.
Nykam Solutions LLC retains ownership of its proprietary frameworks, methodologies, processes, templates, tools, models, systems, business methods, and other intellectual property unless expressly transferred in writing. This includes, without limitation, True Cost Clarity™, The S.T.R.A.T.A. Framework™, and the underlying methodologies, processes, tools, and intellectual property used to deliver them. Payment for consulting services does not transfer ownership of this intellectual property.
Clients may use materials specifically created and delivered for their engagement for their own internal business purposes, subject to the applicable engagement agreement. Clients may not reproduce, resell, license, distribute, publish, commercialize, or use our proprietary frameworks, methodologies, or materials to provide consulting services to third parties without prior written authorization.
Information provided during an engagement remains subject to the confidentiality obligations established in our Confidentiality Policy and any applicable non-disclosure agreement. Your confidential information remains your information. Our proprietary methodologies and intellectual property remain the property of Nykam Solutions LLC.
If we are unable to continue an engagement for reasons within our control, we will make reasonable efforts to notify the client and determine an appropriate resolution. Depending on the circumstances, this may include rescheduling, transferring the engagement to another available service date, completing the current milestone, or refunding amounts paid for eligible services that have not been performed.
Cancellation and refund requests must be submitted in writing to consulting@nykam-solutions.com, including your name, the service or package purchased, purchase date, and requested resolution. We will review the request based on this policy and the applicable engagement agreement.
Nothing in this policy is intended to limit any right, remedy, refund, cancellation right, or other protection that cannot legally be waived or restricted under applicable law. Where applicable law provides a greater right than the terms stated in this policy, applicable law will control.
